Arroyo aide might be barred from 'Garci' probe

Sergio Apostol, presidential chief legal counsel, on Monday said Malacañang might forbid Undersecretary Remedios “Medy" Poblador from testifying in the Senate’s reinvestigation of the “Hello, Garci" wiretapping controversy.

He said Poblador, being an undersecretary, is still covered by Executive Order 464. The order prevents Cabinet, police, military and security officials from attending congressional hearings without a go-signal from the President.

In April 2006, the Supreme Court partly voided EO 464, but ruled that Congress must explain the kind of legislative inquiry that it wants to conduct, including questions to be asked of the witnesses. The high court also ruled that the executive branch must be given time to consider invitations for congressional inquiries.
“The Palace may still refuse based on that decision. Even if the Senate will comply with the requirements, the Palace can still refuse," Apostol said.

Meanwhile, Cabinet Secretary Ricardo Saludo reiterated that the Palace did not order Poblador to stop former military spy Vidal Doble from revealing the source of the “Garci" tapes.

The tapes allegedly contained wiretapped conversations between President Gloria Macapagal Arroyo and former elections Commissioner about the rigging of the results of the 2004 presidential elections. Mrs Arroyo and Garcillano denied the allegation.

Saludo countered insinuations that the Palace had a hand in Poblador’s involvement in Doble’s transfer to the AFP camp, saying Poblador voluntarily “mediated between the Church and security forces to resolve a tense situation."

Doble earlier claimed Poblador was among the people who went to fetch him from the San Carlos Seminary in Guadalupe, Makati in June 2005 and brought him to the quarters of the chief of the Armed Forces of the Philippines at Camp Aguinaldo in Quezon City. - GMANews.TV
