MANILA, Philippines -- The Court of Appeals will not stop the Office Ombudsman from implementing a suspension order against an Army major general facing graft charges.
In a four-page resolution, the appeals court’s 13th division, through Associate Justice Japar Dimaampao, said Major General Jose Barbieto failed to show any clear proof that he is entitled to a temporary restraining order or writ of preliminary injunction against his suspension.
"After due consideration of the factual circumstances of the instance case, we find no compelling reason to issue an injunctive writ and/or temporary restraining order," the court said.

MANILA, Philippines - The Court of Appeals has extended the freeze order on 32 of the 70 bank accounts listed under the name of former agriculture undersecretary Jocelyn "Joc-Joc" Bolante and some other individuals and entities allegedly linked to the P728-million fertilizer fund scam.
In a 30-page resolution penned by CA Associate Justice Pampio Abarintos, the CA's Former First Division granted the petition of the Anti-Money Laundering Council (AMLC) to extend the freeze order, which lapsed last August 20, so that it can continue with its investigation.

After its agency head became entangled in the Court of Appeals (CA) bribery scandal, the Presidential Commission on Good Government (PCGG) is in the news once more.
Aside from the alleged involvement of PCGG chairman Camilo Sabio in the Meralco-Govenment Service Insurance System controversy, the agency is in hot water anew after the Commission on Audit (COA) uncovered several financial irregularities.
Based on a 2007 COA report, at least $34.1 million or over P1 billion of recovered Swiss deposits of the late strongman Ferdinand Marcos, held in escrow at the Philippine National Bank (PNB) and forfeited in favor of the Philippine government, were unaccounted for or unrecorded in the PCGG's book of accounts.

COURT of Appeals Associate Justice Jose Sabio will continue his testimony today about the bribery scandal stemming from the lawsuit between the group of businessman Manuel Lopez and the Government Service Insurance System over control of Manila Electric Co.
Sabio is expected to go under intense questioning from the lawyer of businessman Francis de Borja, whom the magistrate accuses of offering P10 million in exchange for Sabio’s inhibition from the case. De Borja denies the charge and claims that it was Sabio who has sought P50 million in payment.

Two mining companies with ties to former Environment Secretary Michael Defensor have clinched deals to operate a mineral exploration site in Botolan, Zambales, along with a Chinese company.
Defensor's links to NiHAO Mineral Resources Inc. and Geograce Resources Philippines were revealed during the signing Thursday of the $150-million joint venture agreement for mineral exploration in Botolan between the two companies and China's Jiangxi Rare Earth and Rare Metals Tungsten Group.
